Welcome to Indicadora ("we", "us", "our"). By accessing or using our website at indicadora.com (the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service.

1. Service Description

Indicadora is a reselling intelligence platform offering two core capabilities:

1.1 Market Search

We aggregate publicly available listing data from public marketplaces, search interest data, community signals, and product catalogue information from third-party databases to provide pricing analytics, market indicators, sale velocity metrics, risk assessments, and AI-powered market intelligence across multiple product categories.

1.2 QC Assistant (Quality Check)

Our AI-powered Quality Check assistant allows users to upload photographs of trainer/sneaker products for automated quality analysis. The service uses artificial intelligence (including third-party AI models) to inspect uploaded images, identify potential defects, stitching issues, material inconsistencies, and known replica indicators, and produce an annotated quality report with severity scores and an overall verdict.

Important: All metrics, scores, and assessments displayed by either service are estimates generated by AI models based on available data. Market Search results are derived from public marketplace listings and should not be treated as financial advice. QC Assistant results are AI-generated opinions and do not constitute a guarantee of authenticity, nor do they replace professional authentication services.

2. Account, Credits & Billing

To access the Service you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

2.1 Credits System

Both Market Search and QC Assistant are powered by a unified credit system. Free accounts receive a limited number of credits on signup. Additional credits can be purchased as stackable packs with no expiry. Each feature consumes credits at rates published on our Pricing page, which may be updated from time to time.

2.2 Credit Deduction

Credits are deducted only after a successful result is delivered. If a search returns insufficient data or a QC analysis fails to complete, no credit is charged. Credits are non-refundable once consumed for a successful result.

2.3 Purchases

All payments are processed by Stripe. We do not store or have access to your payment card details. Purchases are one-time payments — we do not operate subscriptions unless explicitly stated.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, scrape, or programmatically access the Service outside of provided interfaces.
• Resell, redistribute, or sublicense data obtained from the Service without written permission.
• Interfere with or disrupt the integrity or performance of the Service.
• Impersonate another person or misrepresent your affiliation with any entity.
• Upload illegal, obscene, or harmful content, or images you do not have the right to share.
• Attempt to circumvent rate limits, credit checks, or security measures.
• Use automated tools or bots to access the Service at scale without prior written agreement.

4. Intellectual Property

All content, design, logos, AI models, and software comprising the Service are owned by or licensed to Indicadora. Third-party platform names and logos are trademarks of their respective owners and are used here for identification purposes only.

4.1 Your Content

You retain ownership of all images and content you upload to the Service. By uploading images to the QC Assistant, you grant Indicadora a non-exclusive, worldwide, royalty-free licence to use, process, store, and analyse those images for the purposes described in Section 5 (including AI model improvement). This licence survives account deletion for anonymised/aggregated training data only — see Section 5.3 for details.

5. Data We Collect & How We Use It

We are committed to transparency about what data we hold and how it is processed. For full details, see our Privacy Policy.

5.1 Personal Data

• Email address — used for account authentication and transactional emails (e.g. email confirmation, password reset).
• Search queries — logged to provide the Service and improve search relevance. Queries are associated with your user ID.
• Usage metrics — searches used, QC checks performed, plan type, timestamps. Used for billing, rate-limiting, and service analytics.

5.2 User-Uploaded Images (QC Assistant)

• Photographs — images you upload for QC analysis are stored securely in our cloud infrastructure and processed by AI models (including OpenAI GPT-4o).
• Processing — images are sent to third-party AI providers for analysis. These providers process images according to their own data processing agreements and do not retain images beyond the API request lifecycle.
• Retention — uploaded images are retained for up to 90 days after analysis to allow you to review results, after which they are automatically deleted. See Section 5.3 for training data exceptions.

5.3 AI Model Training & Improvement (Training Data Consent)

We collect and use anonymised data from your uploaded images for AI model training.By using the QC Assistant, you consent to Indicadora using anonymised and aggregated data derived from your uploaded images (such as defect patterns, quality metrics, annotation coordinates, and model-specific flaw frequencies) to improve our AI models and the accuracy of the Service. This is disclosed in compliance with GDPR, UK GDPR, and our commitment to transparency. We do not use raw images for training; only de-identified metadata and patterns. Specifically:

• We may use anonymised quality analysis data (defect types, scores, annotations) for internal model training.
• Personally identifiable information is stripped before any data is used for training.
• We do not sell or share your images with third parties for their own training purposes.
• Third-party AI providers (e.g. OpenAI) process images under zero-data-retention API agreements — they do not use your images to train their own models.
• You may withdraw consent for future training use by contacting privacy@indicadora.com. Previously anonymised data that has been incorporated into model weights cannot be individually removed.

5.4 Marketplace Data

We collect publicly available listing information from marketplace APIs, search trend data, and community discussion data. This data is factual in nature and is processed to generate aggregate, non-personally-identifiable market intelligence.

5.5 What We Do NOT Collect

• Payment card details — payments are processed by Stripe; we never see or store card numbers.
• Precise geolocation data.
• Data from social media profiles, contacts, or device sensors beyond standard HTTP headers.

6. GDPR Compliance

If you are located in the European Economic Area (EEA) or the United Kingdom, the following applies under the UK GDPR and EU General Data Protection Regulation:

6.1 Lawful Bases for Processing

• Contract performance — we process your email, search data, and uploaded images to provide the Service you signed up for (Market Search results and QC analysis reports).
• Legitimate interest — we process aggregated marketplace data to generate market intelligence. We have assessed that this does not override the rights of the listing creators as the data is publicly available.
• Consent — use of anonymised image data for AI model training (Section 5.3), and marketing emails where applicable. You may withdraw consent at any time.

6.2 Your Rights

Under GDPR you have the right to:

• Access — request a copy of the personal data we hold about you, including uploaded images.
• Rectification — request correction of inaccurate data.
• Erasure — request deletion of your personal data and uploaded images ("right to be forgotten").
• Portability — receive your data in a structured, machine-readable format.
• Restriction — request we limit processing of your data.
• Object — object to processing based on legitimate interest or withdraw consent for AI training.

To exercise any of these rights, email us at privacy@indicadora.com. We will respond within 30 days.

6.3 Data Retention

• Account data — retained for as long as your account is active. Erased within 30 days of account deletion, except where retention is required by law.
• Search logs — retained for up to 12 months, then anonymised or deleted.
• QC images — retained for up to 90 days after analysis, then automatically deleted.
• Anonymised training data — aggregated, de-identified quality metrics may be retained indefinitely as they contain no personal data.
• Marketplace analytics — aggregated, non-personal analytics may be retained indefinitely.

6.4 International Transfers

Our infrastructure is hosted on Supabase (AWS eu-west regions) and Vercel (edge network). AI image analysis is processed via OpenAI API endpoints (US-based). Where data is processed in jurisdictions outside the EEA, we rely on Standard Contractual Clauses (SCCs) or adequacy decisions to ensure an adequate level of data protection.

7. Data Security

We implement appropriate technical and organisational measures to protect your data, including:

• Encryption in transit (TLS 1.2+) for all connections, including image uploads.
• Encryption at rest for database storage and file storage (AES-256).
• Row Level Security (RLS) policies to ensure users can only access their own data, images, and QC reports.
• Service-role separation — API keys with least-privilege access.
• Rate limiting and abuse prevention on all API endpoints.
• Input validation and sanitisation on all user inputs.
• Regular dependency audits and security patching.
• Uploaded images stored in access-controlled buckets — not publicly accessible.

While we follow industry best practices, no method of electronic storage is 100% secure. We cannot guarantee absolute security but will notify affected users promptly in the event of a data breach, in compliance with GDPR Article 33/34.

8. Compliance Standards

8.1 GDPR (General Data Protection Regulation)

We comply with the UK GDPR and EU GDPR as detailed in Section 6 above. This includes lawful processing of user-uploaded images for QC analysis and model training, with clear consent mechanisms and data subject rights.

8.2 SOC 2 — Security & Trust

While Indicadora is not currently SOC 2 Type II certified, our infrastructure providers maintain SOC 2 compliance: Supabase (AWS) holds SOC 2 Type II certification, Vercel maintains SOC 2 Type II, and Stripe is SOC 2 certified. We align our internal practices with SOC 2 Trust Service Criteria including security, availability, and confidentiality. User-uploaded images are stored in access-controlled, encrypted storage and processed under strict data handling procedures. We intend to pursue formal certification as the company scales.

8.3 ISO 27001 — Information Security

Our infrastructure providers (Supabase/AWS, Vercel) maintain ISO 27001 certification. We align our internal practices with ISO 27001 principles, including access control, incident management, and risk assessment.

8.4 HIPAA (Health Insurance Portability and Accountability Act)

Indicadora does not collect, store, or process Protected Health Information (PHI). The Service is not intended for use in healthcare contexts and is not HIPAA-compliant. We do not handle medical, health, or biometric data. If your use case involves PHI, do not use this Service.

8.5 PCI DSS

We do not handle, process, or store payment card data. All payment processing is delegated to Stripe, which is PCI DSS Level 1 certified. No cardholder data ever touches our servers.

9. Cookies

We use strictly necessary cookies for authentication session management (Supabase Auth tokens). We do not use advertising cookies or third-party tracking pixels. Analytics, if added in future, will be disclosed and subject to consent where required by law.

10. Third-Party Services

The Service integrates with the following third-party providers. By using the Service, you acknowledge that your data may be processed by these providers under their own privacy policies and data processing agreements:

• Supabase (database, authentication, file storage, edge functions) — Privacy Policy
• Vercel (hosting, CDN) — Privacy Policy
• Stripe (payment processing) — Privacy Policy
• OpenAI (AI image analysis and text generation for QC and Search) — Enterprise Privacy. We use their API with zero-data-retention agreements; your data is not used to train OpenAI models.

11. Disclaimers & Limitation of Liability

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, or reliability of any marketplace data, pricing estimates, sell-through metrics, or quality assessments.

QC Assistant: Quality check results are AI-generated opinions and should not be treated as a definitive authentication or appraisal. Indicadora does not guarantee that any item analysed is genuine or counterfeit. Users should exercise their own judgement and seek professional authentication services where appropriate.

To the maximum extent permitted by law, Indicadora shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service, reliance on market data, or decisions made based on QC analysis results.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
